I'm selling the domain for a friend (the person who owns the domain, which isn't Emathia). Emathia runs the website, yet he doesn't own the domain so the owner is well within his rights to sell it

Does the person who owns the domain also own (note: I didn't say 'run') the website running on it? Is it leased to Emathia or just free for them to use? Why isn't Emathia buying the domain?
