Nope, this is not aloud. if you have a site that could resell them yes, but unless you have TM's approval i don't think you should take the risk in trying to sell these.

He can't sell them no matter how he got them. Wether it was legally or illegally, in TemplateMonsters FAQ it states that templates cannot be resold/redistributed.
