The ball only comes back on mine off some of the walls, on the others it “explodes”. Exactly like there game.

I designed this game in photoshop myself, I then handed all of the levels + concept ideas to my flash designer to code. So yes, I am sure that they ripped off out game and not the other way round.

Just a thought Jon...could it be that you both had the same idea? I mean it reminds me of alot of similar games i've played before in the past.

That would be a possibility if the ball didn’t start in exactly the same place, the end wasn’t in exactly the same place, the arrow didn’t look exactly the same, the same style levels (with moving + flashing blocks, some you can bounce off, some you can’t).

I would bet my life on it that they openly and outright copied ball bounce.

Get a lawyer on to it Jon, don't fool around in here asking for advice because you keep getting the same replies that you don't accept. If you are adamant that you have a solid case, and you competitors are profiting from their version then get a lawyer.

Is the loss of money on the game more than what it would cost for a lawyer if you did loose your case? If not, it's better to just cut your losses.

If you did not 'register' this game ideas as your own, you really can't do much in court.(as far as US court goes, not sure how UK or wherever's court operates.)

You have to remember, you can design products to specs taken from another product, but you cant design them with parts taken from another product.

In regards of what you said about tetris and how people make spin-offs. This is exactly the same as your case. People took the exact idea of tetris, changed graphics and thats it. It still has the increasing difficulty as the player progresses throught the game...where the blocks start falling faster. It still has the same blocks where you have to turn them. It still has the same idea about how you have to fill up a row...etc

This resembles your case. They took your idea and made a spin-off off of it. I don't see the harm done. It's a simple flash game.

Also note that you would end up spending more money with the lawyer.

In my opinion I don't think its a rip off and if it is you probably don't have a case. I mean I understand you created it from the ground up but there is no proof that they copied your idea. In fact becuse it seems that their idea is more developed with better graphics and such if you take it to court they would probably win. Unless you have solid evidence that you were the first to do it and they literally saw your game on your website and then developed one exactly like it you're not going to have much of a case.

Ideas can't be copyrighted - only something physical. Unless it's the exact same code, or the exact same graphics, you don't have a case here unfortunately.
