My flash game has been ripped off, is there anything I can do?

Recently we launched a flash game called ball bounce. We designed this game from the groud up, the concept was 100% original and so was all the coding.

Yesterday I stumbled across this game by flash games 247. It is, for all intensive purposes exactly the same apart from a few updated graphics.

Do I have a case? Can I do anything?

Any help is much appreciated!
Thanks,
Jon

Hmmm, I don't really think you got, as (it look's like) they made it from ground too.
It is a nice game though

their's is nice but they have one major flaw...

if you shoot it straight so that it bounced off a pillow staight back into the wall it will just bounce endlessly at least on yours there is a reset button

That’s irrelevant, it’s my idea that they stole. Regardless if they made it from the ground up, surely I own the copyright to the idea / concept?

Do you have proof of creation, or is it locked within flash files. I'm not completely sure but I think that you could claim some kind of intellectual copyright, try e-mailing the site owner and asking him nicely to remove the game before you take matters further.

The big question is: Is it harming anyone? Are you losing money because of it?
