  Old  Am i in the wrong?

A client, wanted to buy a Video Site off me.

We decided $80,

He paid $40 upfront.

He wanted me to Make more banners, add more videos, change the skin, and edit it a lot, aswell as give him the site.

So i do all of the above, accept give him the site.

The next day, he says he dont want it.

Do i give him the money back or keep it?

I offered $20 (50%) back and he said no.

Am i in the wrong or what?

I've done that work for f.a basically if i refund him.

You keep all of it, your work, your money. Refunding deposits defeat the whole purpose of them.

Here is my refund policy

3. Refunds
A refund of the deposit or previous payments (if applicable) will only be issued if I am physically unable to complete the project. No refunds on the final amount will be issued for any reason after client receives files.

Keep it, if you already started a business deal you can't go back on it.

Its like, order a meal at an italian restaurant, eat half of it, then decide eh i'm not in the mood for italian anymore i want mexican, do i have to pay?

Yeah It's deffinately your money. This is a good example of why you should agree on terms fully before your proceed with anything. Possibly even make him sign a contract.

That's probably the best example in this situation. You made it, he didn't want it anymore, yet the deposit is for what time you took and it seems wasted...

Sorry that your in that situation buddy...

Wow, so much wrong in so little time.

1. You priced the site at $80. That should have been the deal and YOU should have stuck to it. The extra labor should have been priced separately.

2. Because you didn't price your labor separately, it was worth the difference between the site price and the site price + labor price, which is to say: NOTHING. You devalued yourself. No one else did that.

3. Because your labor was worth nothing to begin with, you can't be upset that he wants his money back on the site if he didn't get the site. You might as well get annoyed at yourself and not the guy. You set the price of your labor by giving it away in the first place.

All that said: was the $40 given with an understanding that it was a non-refundable deposit? If no expectation was given either way, you should error on the side of angels and give him his money back. All you are out then is your time and labor, which you already valued at $0.
